General Terms and Conditions (GTC)

1. Scope of Application

These Terms and Conditions apply to all orders placed via our online shop. Our online shop is intended exclusively for consumers.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession. An entrepreneur is a natural or legal person, or a legal partnership, acting in the course of their business or professional activity when concluding a legal transaction.

2. Contracting Party, Conclusion of Contract, Correction Options

The purchase contract is concluded with SC SIMAUSROM COMSERVIMPEX SRL.

By listing products in our online shop, we make a binding offer to conclude a contract for those items. You may place products in your shopping cart without obligation and adjust your entries at any time before submitting your binding order by using the correction tools provided during the order process. The contract is concluded when you accept the offer by clicking the order button. Immediately after submitting the order, you will receive a confirmation email.

3. Contract Language and Storage of Terms

The languages available for contract conclusion are: German and English.

We store the contract text and send you the order details and our GTC by email. You can view the contract text via your customer account login.

4. Delivery Conditions

Shipping costs may apply in addition to the product prices displayed. You can find more details in the individual product offers.

We deliver only via shipping service – self-collection is not possible.
We do not deliver to Packstations.

5. Payment Methods

The following payment methods are generally available in our shop:

  • Prepayment
    We will provide our bank details by separate email and ship the goods after receiving your payment.

  • Credit Card
    When placing the order, you enter your credit card details. After verification, the payment will be automatically processed.

  • PayPal, PayPal Express
    You will be redirected to PayPal’s website during checkout. You must be registered or register with PayPal, log in, and confirm the payment. We will initiate the transaction with PayPal after you submit your order.

  • Sofort by Klarna
    You will be redirected to the website of Sofort GmbH. You must have an online banking-enabled account, verify your identity, and confirm the payment.

  • Giropay
    You will be redirected to your bank’s website. You must have an online banking-enabled account, verify your identity, and confirm the payment.

  • Apple Pay
    Available via Safari. You must be registered with Apple and activate Apple Pay.

  • Google Pay
    Available if you’re registered with Google and have Google Pay activated.

6. Retention of Title

The goods remain our property until full payment is received.

7. Transport Damage

If goods arrive with obvious shipping damage, please report this to the carrier immediately and contact us without delay. Failing to do so does not affect your statutory rights but helps us assert claims against the shipping carrier.

8. Warranty and Guarantees

Unless otherwise expressly agreed below, statutory warranty law applies.

For used goods:
Claims for defects are excluded if the defect appears more than one year after delivery. Claims for defects that appear within one year can be asserted within the legal limitation period of two years.

The above limitations do not apply to claims arising from:

  • injury to life, body, or health

  • intentional or grossly negligent breaches

  • breach of essential contractual obligations (cardinal duties)

  • promises of guarantee (if agreed)

  • liability under the Product Liability Act

Exclusion of Warranty
Warranty covers material or manufacturing defects only. Damages from improper use, wear and tear, or external factors (e.g., scratches from regular use) are excluded.

9. Liability

We are fully liable for:

  • injury to life, body, or health

  • intentional or grossly negligent breaches

  • agreed-upon guarantees

  • liability under the Product Liability Act

For breaches of essential contractual obligations caused by slight negligence, our liability is limited to foreseeable, typical damages.

Beyond that, all claims for damages are excluded.

10. Dispute Resolution

The European Commission provides an online dispute resolution platform (ODR).
We are not obliged or willing to participate in dispute resolution proceedings before a consumer arbitration board.
